General Terms and Conditions of Sale
These Terms and Conditions govern all purchases made via the online shop www.tworelax.com, operated by Belvicon Ltd ("Belvicon Ltd", "we", "us", "our").
1. Scope
These terms apply to all orders placed by consumers (B2C) through our online shop within the European Union (excluding Hungary). A consumer is any natural person who concludes a legal transaction for purposes that are not predominantly related to their commercial or self-employed professional activity (Art. 2(1) Directive 2011/83/EU).
2. Contracting Party
The purchase agreement is concluded with Belvicon Ltd (registered in Cyprus under HE 492478).
3. Contract Formation
(a) Product listings on our website are non-binding invitations to place an order. (b) By placing an order through the online checkout process, you make a binding offer to purchase the selected goods. (c) A contract is formed when you receive an order confirmation email from us. (d) Orders are fulfilled by our EU-based manufacturer and logistics partners on our behalf, shipping directly to the customer.
4. Prices and Payment
(a) All prices displayed on the website include statutory VAT (once applicable) and are stated in euros (EUR). (b) Accepted payment methods: credit card, debit card, PayPal, Klarna. (c) Payment is due immediately upon checkout. (d) In case of non-payment, we reserve the right to cancel the order.
5. Delivery and Performance
(a) Goods are delivered within the European Union (excluding Hungary). (b) Typical delivery period is 5–12 working days from order confirmation. Larger items (whirlpools, swim spas) may require prior delivery coordination. (c) "Performance" (fulfilment of contract) occurs when the ordered goods are delivered in full and undamaged to the customer. (d) Ownership of the goods transfers to the customer only after full payment has been received. (e) We reserve the right to withdraw from the contract if delivery by our supplier is impossible for reasons beyond our control. The customer will be notified promptly and any payments already made will be refunded without delay.
5.1 Missed Deliveries and Failed Delivery Attempts
Delivery of bulky goods such as whirlpools requires prior coordination and the presence of the customer or an authorised representative at the agreed delivery time. A delivery attempt shall be considered failed if delivery cannot be completed due to reasons attributable to the customer, including: absence at the agreed delivery time; incorrect or incomplete delivery address; failure to respond to delivery coordination attempts; insufficient access conditions (narrow access, lack of unloading space, missing lift, restricted entry); refusal of delivery without a legally valid reason.
In such cases we reserve the right to charge the customer for any additional costs incurred, including redelivery, return transport, storage or handling fees. If a delivery attempt fails due to reasons attributable to the carrier or our suppliers, no additional costs shall be charged to the customer.
6. Shipping, Returns and Costs
(a) Delivery is made either directly from our EU manufacturer to the customer, or via freight forwarding partners arranged by Belvicon Ltd. (b) Shipping costs are displayed during checkout. (c) For exercises of the statutory right of withdrawal under §8 below, Belvicon Ltd covers the return shipping costs as a premium service to our customers, provided the goods are returned unused and in original packaging. (d) For confirmed defective products, return costs are likewise covered by Belvicon Ltd.
7. Warranty and Liability
(a) The statutory warranty period applies according to EU and applicable national law — minimum 24 months from delivery to the end customer (e.g. §438 BGB in Germany; §933 ABGB in Austria). (b) Warranty claims apply only to manufacturing defects existing at the time of delivery. (c) Damage resulting from improper installation, misuse, neglect, or normal wear and tear is not covered. (d) The customer is responsible for ensuring installation is performed by a qualified electrician in compliance with the manufacturer's user and installation manual, including the mandatory residual current device (RCD) and other technical requirements.
(e) We are not liable for: misuse or incorrect installation of whirlpools or accessories; use of inappropriate chemicals or maintenance methods; damage caused by freezing where the customer has not winterised the product per manufacturer guidance; indirect or consequential damages (unless caused by gross negligence or intent). (f) This limitation does not affect mandatory consumer protection rights under EU and applicable national law.
7.2 Manufacturer's Extended Warranty
Wellis hot tubs, swim spas, ice baths and related products are supplied with a Manufacturer's Limited Warranty backed by Wellis Magyarország Zrt. (H-1118 Budapest, Budaörsi út 31/C, Hungary) as the manufacturer. The warranty terms, durations and exclusions are set out in the Wellis Limited Warranty document supplied with each unit. TwoRelax administers warranty claims as the authorised distributor for Germany and Austria, coordinating with Wellis as manufacturer for repair authorisations, spare parts and reimbursement. Warranty service is provided in accordance with the manufacturer’s warranty terms and procedures and is subject to the continued availability of original manufacturer spare parts and technical support.
7.3 Force Majeure & Manufacturer Continuity
In the event that performance of the Manufacturer’s Extended Warranty becomes impossible or commercially impracticable due to events outside TwoRelax’s reasonable control — including but not limited to insolvency, dissolution, cessation of operations or withdrawal of products from the European market by Wellis Magyarország Zrt., unavailability of original manufacturer spare parts, or termination of TwoRelax’s distribution authorisation — TwoRelax’s warranty performance is suspended to the extent of such impossibility. In such circumstances TwoRelax will use commercially reasonable endeavours to provide alternative spare parts at cost price and to assist customers in obtaining warranty redress directly from the manufacturer where possible. Statutory warranty rights under EU Directive 2019/771 remain unaffected.
7.4 Goodwill Cancellation Fee
(a) Customers retain their full statutory 14-day right of withdrawal as set out in §8 below, subject to the hygiene exception for hot tubs, swim spas and other hygiene-sensitive products once unsealed, installed, filled with water, connected to electricity or plumbing, or otherwise rendered unsaleable.
(b) Where the customer’s statutory right of withdrawal no longer applies (because the 14-day period has expired, because the product has been unsealed/installed and the hygiene exception applies, or for any other lawful reason), TwoRelax is not obliged to accept further cancellation requests.
(c) TwoRelax may, at its sole discretion, agree to a goodwill cancellation of a hot tub or swim spa order in such circumstances. If TwoRelax agrees to such a goodwill cancellation after the manufacturer has confirmed the order and TwoRelax has paid the manufacturer’s advance payment, a goodwill cancellation fee of 15 % of the purchase price applies, reflecting non-recoverable manufacturer costs paid by TwoRelax.
(d) The customer remains entitled to demonstrate that TwoRelax’s actual damage from the cancellation was lower than 15 % of the purchase price, in which case the lower amount applies (§309 Nr. 5 BGB).
(e) This clause does not affect or limit the customer’s statutory rights or any other rights set out elsewhere in these Terms.
8. Right of Withdrawal (Cancellation Policy)
(according to the EU Consumer Rights Directive 2011/83/EU as implemented in national law, e.g. §312g BGB in Germany; §3 FAGG in Austria)
Consumers have the right to withdraw from this contract within 14 days, unless one of the legal exceptions applies (see "Hygiene Exception" below). The withdrawal period is 14 days from the day on which you, or a third party named by you (other than the carrier), received the goods.

Hygiene Exception for Hot Tubs, Swim Spas, Cold Plunges and Wellness Products (Article 16(e) Directive 2011/83/EU)
Hot tubs, swim spas, cold plunges and related wellness products are hygiene-sensitive sealed goods. For reasons of health protection the right of withdrawal does not apply once the product has been: unsealed in a way that compromises hygiene; connected to electricity or plumbing; filled with water (even partially); run, activated, or powered on; had chemicals added or water circulated; had jets, pumps, heating or sanitiser systems operated; installed or placed in a way that requires tools, assembly, technical work, or removal of safety packaging; removed from its transport pallet in a way that prevents safe return transport.
Once any of these actions occur, the product cannot be hygienically restored and withdrawal is legally excluded.
Inspection Rights
Consumers may open the outer packaging only to the extent necessary to inspect the goods, as they would in a showroom. Removing excessive packaging, damaging packaging, or handling the product beyond inspection may result in diminished-value deductions or refusal of return.
Returns Are Only Accepted If the Product Is:
unused; uninstalled; never filled with water; never connected or wired; hygienically intact; in original packaging (packaging may be opened for inspection but must be resealed immediately); on a pallet or equivalent and ready for freight pickup; accessible for collection. If these conditions are not met, the return may be legally refused.
Diminished Value (Article 14(2) Directive 2011/83/EU)
If a return is accepted but the product shows signs of handling beyond what is necessary for inspection, we may deduct an appropriate amount: up to 100% if the item has been installed, used, filled with water, or otherwise rendered unsaleable.
Return Shipping Costs (Article 14(1) Directive 2011/83/EU)
Although the EU Consumer Rights Directive permits the seller to pass return shipping costs to the consumer, Belvicon Ltd voluntarily covers the freight cost of returns for valid statutory withdrawals, provided the returned goods are unused and in original packaging and the return is coordinated through Belvicon Ltd as set out in the RMA process below.
RMA Approval Required
All returns require prior authorisation (RMA). Customers must provide: photos or video of the product; confirmation of unused and hygienic condition; confirmation that packaging and pallet are available; confirmation of access for pickup. Returns without RMA approval will not be accepted.
Refunds
If the return is approved, we will refund: the product price; standard delivery cost (our standard delivery is free, so €0); paid premium delivery services (e.g. white-glove delivery) are not refunded. Refunds are issued within 14 days after receiving the returned goods or proof of return shipment, whichever is earlier.
9. Retention of Title
The goods remain our property until full payment has been received.
10. Governing Law and Jurisdiction
(a) All contracts are governed by the law of the Republic of Cyprus, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). (b) Mandatory consumer protection provisions of the customer's country of residence remain unaffected. (c) Jurisdiction lies with the competent courts in Cyprus, without prejudice to the consumer's right to bring proceedings in the courts of their country of residence under applicable EU law.
11. Dispute Resolution
The European Commission provides an online dispute resolution platform (Art. 14(1) Regulation (EU) 524/2013): https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in consumer arbitration procedures before a dispute resolution body.
Lowest Price Match Guarantee
We aim to offer the most competitive price on identical products. If, before your purchase or within 14 days of it, you find the same product — identical model, specification and condition (new, boxed and in stock) — offered at a lower total price by another authorised retailer based in Germany or Austria, contact us with a verifiable link or written quotation and we will review your request.
Where the claim is validated, we will either refund the difference or, at our discretion, offer a comparable benefit. This guarantee is a voluntary commercial commitment and does not affect your statutory rights. It does not apply to: marketplace or third-party seller listings; used, ex-display, clearance, liquidation or auction items; time-limited promotions, bundle or member-only pricing; cashback or voucher offers; differences in delivery, installation or finance costs; and obvious pricing errors. The compared price must be genuine, publicly available and in stock at the time of your request. We verify each claim and reserve the right to decline where these conditions are not met.

3. Purpose and Legal Basis of Processing

4. Data Retention
We retain personal data only as long as necessary: order and billing data — 7 years (tax-law requirement); customer communications — up to 2 years after resolution; newsletter data — until consent is withdrawn; analytics data — 14 months (default retention); consent records — 12 months from collection.
5. Data Sharing and Processing Partners
We share personal data only with trusted EU-based or GDPR-compliant service providers as necessary for our operations: Website and hosting — Shopify International Ltd. (Ireland) and Shopify Inc. (Canada); Payment processing — PayPal, Stripe, Shopify Payments, Klarna; Analytics — Google Analytics (see Cookie Policy); Email and newsletter — Shopify Email or equivalent GDPR-compliant provider; Consent management — Silktide (silktide.com); Freight forwarding, delivery, warranty and service — our manufacturer (Wellis Magyarország Zrt., Hungary) and our designated third-party logistics partners in Germany and Austria (and other EU Member States as we expand). All partners are bound by Data Processing Agreements (DPAs) ensuring GDPR compliance.
6. International Data Transfers
If our service providers process data outside the EU/EEA (e.g. Shopify, Google), they do so under EU Standard Contractual Clauses (SCCs) or other approved transfer safeguards as required by Chapter V of the GDPR.

1. Manufacturer's Documentation Prevails
Any maintenance, installation, cleaning or chemical-use guidance provided on our website, blog, or communication channels is for informational purposes only and does not constitute professional, technical or safety advice.
Customers must always follow the manufacturer's official user and installation manual supplied with their specific product, applicable product Safety Data Sheets (SDS), and local safety regulations when using, installing or maintaining whirlpools, swim spas, cold plunges, saunas or related products. Where our website guidance differs from the manufacturer's documentation, the manufacturer's documentation prevails.
2. Installation Requirements
Installation of all whirlpools, swim spas, cold plunges, and other electrically powered wellness products supplied by Belvicon Ltd must be performed by a qualified electrician and must comply with the applicable national electrical regulations. This includes:
— Connection through a residual current device (RCD) with a release current not exceeding 30 mA;
— Use of an earthed connection;
— Clearance from metal surfaces and other electrical equipment as set out in the manufacturer's manual;
— Compliance with the EU Low Voltage Directive 2014/35/EU and applicable national regulations (e.g. ElektroG and DIN VDE in Germany; Elektrotechnikgesetz in Austria).
Failure to install per the manufacturer's manual may void the manufacturer's warranty, invalidate insurance, and create personal safety risk.
3. Safe Use
Customers are responsible for ensuring that all users of the products are aware of the safety information set out in the manufacturer's user manual, including:
— water temperature limits (maximum 40 °C / 104 °F for whirlpools);
— supervision of children under 14;
— medical advisories (heart conditions, blood pressure, circulation disorders, diabetes, pregnancy);
— alcohol and drug interaction warnings;
— use of approved water-care chemicals and safe handling thereof;
— winterisation (freeze-protection) requirements in cold-climate regions.
4. Chemical Use and Safety
When handling and using water-care chemicals (chlorine, bromine, pH balancers, oxidisers, cleaning agents): always read and follow the product label and safety instructions; store chemicals securely, away from children and pets; do not mix different chemical products; use only products suitable for your specific product system. We accept no responsibility for any injury, damage or adverse effect resulting from the improper use, handling or storage of chemical products.
5. Product Information
All technical specifications, measurements and descriptions provided on our website are based on information from the manufacturer and suppliers. While we strive for accuracy, product details may change without notice. We are not liable for typographical errors, variations in product appearance, or manufacturer updates beyond our control.

7. Property Damage at the Installation Site
TwoRelax is not responsible for damage to your property (flooring, decking, walls, masonry, electrical installations) caused by:
(a) inadequate pad preparation;
(b) inadequate drainage at the installation site;
(c) freezing damage from failure to drain or maintain the unit in winter;
(d) improper electrical connection performed by you or your electrician;
(e) failure to maintain proper water chemistry;
(f) using accessories not supplied or approved by TwoRelax.
Manufacturing defects are covered separately under the Wellis warranty and your statutory consumer rights.
8. Limitation of Liability
(a) Belvicon Ltd’s liability for personal injury, death, or damage to health caused by intentional or negligent breach of duty by Belvicon Ltd or its representatives is unlimited.
(b) Belvicon Ltd’s liability for damages caused by gross negligence or intentional breach of duty by Belvicon Ltd or its representatives is unlimited.
(c) For damages caused by ordinary negligence in the breach of material contractual duties — meaning duties whose fulfilment is essential to the proper performance of this contract and on whose observance the customer regularly relies — Belvicon Ltd’s liability is limited to foreseeable damages typical of this type of contract, capped at the purchase price of the product giving rise to the claim.
(d) For damages caused by ordinary negligence in the breach of non-material duties, Belvicon Ltd’s liability is excluded.
(e) The above limitations do not affect liability under the Produkthaftungsgesetz (German Product Liability Act), the Austrian Produkthaftungsgesetz, or any other mandatory statutory liability that cannot be limited by contract.
(f) Belvicon Ltd is not liable for indirect or consequential losses including loss of use, costs of removal or reinstallation, damage to surrounding structures (decking, paving, concrete), water damage from leaks, freezing damage, modifications to electrical supply, or consequential repairs, except where such losses fall within (a), (b), or (e) above.
